Terms, Definitions & Conditions

Terms & Conditions of Sale

Antique – Any work of art, piece of furniture, decorative object, or the like, created or produced in a

former period, or, according to U.S. customs laws, 100 years before date of purchase.

 

Vintage refers to a period of origin or manufacture, often associated with items that are at least 20 years old but less than 100 years old, reflecting trends from recent decades. It can also denote something of old, recognized, and enduring interest or quality, like classic wines or collectibles.

 “As is” – All merchandise is sold "as-is" and "where-is" (Meaning Buyer assumes responsibility for any issues listed, including all recalls on an item). NO warranties or guarantees of any kind. We are also unaware of any recalls while listing any items in our auctions. This is the buyers responsibility to check before placing a bid on any item. 

Buyer’s premium – A percentage of the high bid added to the “hammer price” of an item.

Commission – The fee charged to the seller by the auctioneer for providing services; usually a

percentage of the gross selling price of the item(s) established by contract (the Listing Agreement) prior

to the auction.

NO HOLDS / STORAGE  We do not offer holds or storage. Items not picked up within the designated pickup window may be considered abandoned and will be resold or disposed of without refund. 

Any buyer discrepancies must be reported at the seller’s physical location at the time of removal. No exceptions. 

Conditions of sale – The legal terms that govern an auction, including acceptable payment terms,

buyer’s premiums, possession and removal of goods (including storage), absolute or reserve auction,

and other agree upon terms.

By accepting these terms and conditions, you consent to receive emails and SMS messages from Art, Antiques & Etc. related to:  Invoice and settlement emails  Pickup reminders (if applicable)  General auction notifications  (Standard text rates may apply.) 

 All invoices are charged automatically to the card on file at the close of the auction unless cash or alternate payment arrangements were made before the auction closes. A 3% surcharge applies to all card payments.  Cash must be arranged before the auction closes. Cash payments must be completed on the first pickup day or the card on file will be charged.  A paid invoice will be emailed after the auction closes. No shipping available. All sales are final. 


Buyer's Premium

All sales are subject to a buyer's premium of 15% that will be added to the total bid price of the item. For example, if the winning bid is $100 this would be in addition of the buyer's premium of $15 for a total of $115 final price plus tax.

Consignment Services

We offer consignment services for a wide range of items, including antiques, collectibles, and more. Our team will work with you to determine the best pricing and marketing strategy for your items, and will handle all aspects of the sale.

We specialize in online auctions, and can help you reach a wider audience and get the best possible prices for your items. 

Definitions

  

AUCTION LISTING AGREEMENT: A contract executed by the auctioneer and the seller which authorizes the auctioneer to conduct the auction and sets out the terms of the agreement and the rights and responsibilities of each party.

  

BID: A prospective buyer’s indication or offer of a price he/she will pay to purchase property at auction. Bids are usually in standardized increments established by the Auctioneer.

  

COMMISSION: The fee charged to the seller by the auctioneer for providing services, usually a percentage of the gross selling price of the property established by contract prior to the auction.

   

MINIMUM BID AUCTION: An auction in which the Auctioneer will accept bids at or above a disclosed price. The minimum price is always stated in the brochure and advertisements and is announced at the auctions.

MINIMUM OPENING BID: The lowest acceptable amount at which the bidding must commence.

RESERVE: The minimum price that a seller is willing to accept for a property to be sold at auction. Also known as RESERVE PRICE.


RESERVE AUCTION: An auction in which the seller reserves the right to establish a reserve price, to accept or decline any and all bids or to withdraw the property at any time prior to the announcement of the completion of the sale by the auctioneer. Also known as AUCTION WITH RESERVE.

  

NO-SALE FEE: A charge paid by the owner of property offered at a reserve auction when the property does not sell.
